• 1. Validity and object
  • 1.1 Ebook Cambodia is an innovative platform that offers a unique way of reading and listening to books. With its user-friendly website and mobile applications, Ebook Cambodia provides you with the opportunity to discover new books in a concise format through delivering the key insights from non-fiction books or other content on your computer or mobile device. Whether you prefer reading or listening, Ebook Cambodia has got you covered. Its authors transform the most important points of non-fiction books into easily digestible bites that will leave you feeling informed and enlightened. Not only can you expand your knowledge base, but also purchase content on the Platform for download into your personal library where it can be accessed at any time, anywhere. Discovering new books has never been easier with Ebook Cambodia's cutting-edge technology offering both reading and listening options in one convenient location!
  • 1.2 Before you can access and use the Ebook Platform, it is crucial to understand that your usage will be subjected to the (General Terms and Conditions). These terms are non-negotiable, and they determine how you interact with our platform. It's important to note that these conditions are subject to change from time to time according to our discretion. Therefore, it's your responsibility as a user of our platform to ensure that you're familiarized with the most updated version of these General Terms and Conditions before using any of our services. Additionally, any other general terms and conditions belonging to you shall not apply unless we acknowledge their validity in writing. We believe that abiding by these regulations will create a better experience for all users on the Ebook Platform while safeguarding everyone's rights in line with industry standards.
  • 1.3 When using Ebook's Platform, you may notice that no separate contract text is provided for the agreement pertaining to its use. However, this does not mean that there is no clear understanding between you and Ebook. The content of the agreement between both parties is based on these General Terms and Conditions, as well as specific information provided during registration in Section 3. Additionally, when ordering a paid subscription (Section 4) or audiobooks/other content (see Section 6), relevant details will be saved by Ebook and made available in your user account at any time. This ensures that all necessary information regarding your usage of the Platform is readily accessible whenever required. Ultimately, while it may seem unusual for there to be no separate contract text for the agreement concerning the use of Ebook's Platform, rest assured that all pertinent information related to said agreement can be found within these aforementioned sections - providing a comprehensive overview of what such an arrangement entails.
  • 1.4 When registering, purchasing a paid subscription or audiobooks, you accept these General Terms and Conditions.
• 2. Services and rights of Ebook
  • 2.1 Ebook offers "books-in-blinks" and “articles-in-blinks”, jointly referred to as ”Platform Content”, granting the key insights from non-fiction books, articles and other material in minutes. Furthermore, a personal profile is created for users to gather favorite content and apply markers and sorting categories. In addition, they can purchase premium audio content such as audiobooks on the Platform.
  • 2.2 The type of account you selected will determine the extent of the platform Content and license options. Free accounts are covered in Section 3, paid subscriptions are outlined in Section 4, free trials are explained in Section 5, and purchasing Audiobook Content is discussed in Section 6. The license for free accounts/subscriptions/trials is only valid for their duration; however, if you purchase Audiobook Content, it will be available with unlimited access (subject to Section 6).
  • 2.3 The Ebook software applications and content are licensed to you within the scope of the contractual use. The rights to Ebook's service and the content distributed through the service remain with Ebook and/or Ebook's licensors. The Ebook service and its contents are limited to a non-exclusive (simple), time-limited right to personal use (subject to Section 6, your account will have unlimited access to purchased Audiobook Content).
  • 2.4 Ebook owns all trademarks, trade names, logos, domain names, and other distinctive features of the Ebook trademark. Any use of the Ebook trademarks, our trade names, logos, domain names or any other distinctive features of the Ebook trademark is not permitted under the license, whether for a commercial or non-commercial purpose.
  • 2.5 The Platform allows Ebook to show you promotional information if you do not use a paid service.
• 3. Ebook registration
  • 3.1 A registration with Ebook is required in order to use Ebook's services. Registration is open to individuals over 18 years of age. Minors may only register with Ebook if they are at least 14 years old and have the consent of their legal representatives. In order to use Ebook services, you will need to provide proof of your identity, your legal age, or the consent of your legal representative.
  • 3.2 Registering on the Platform is free (free account) and does not entail a paid subscription. By registering, you agree to use the Platform in a limited, free capacity.
  • 3.3 If you would like to register, please use your e-mail address and a password of your choice. Alternatively, you may register by using a single sign-on service (for example, Facebook login, phone number login).
  • 3.4 Ebook has the right to save and process the data you provide during registration, in accordance with data protection provisions.
  • 3.5 Ebook's user account may only be used by you. You must keep the password confidential. You are solely and fully responsible for keeping it a secret. In the event of unauthorized use of your user account or any suspicion of such activity, you should notify Ebook immediately.
• 4. Subscription Agreement Execution
  • 4.1 You can purchase additional service packages in the form of paid subscriptions ("Subscription Access") after registering in order to fully take advantage of Ebook's services. As you can see from the order options, these can be purchased for different and variable periods of time.
  • 4.2 Subscription Accesses are ad-free, paid subscriptions that allow you to access additional content and features through our mobile and web applications. We currently offer the following subscription / service package:
    • As part of the Ebook Premium service package, you will receive ad-free access to all of our Platform Content in both audio and text, as well as the ability to use Send-to-Phone. As long as your subscription is active, you will be able to access the services.
  • 4.3 When you complete the online order form and click the "Order with obligation to pay" button, you submit a legally binding offer for a fee-based subscription. By doing so, you submit a legally binding offer for an agreement for a paid subscription. Before you submit your order, you can make changes and view the data as needed.
  • 4.4 Once Ebook issues a notice of acceptance (order confirmation) via email, the contract is considered complete. If your fee-based subscription was purchased through our web-based application, you will receive the order confirmation and receipt confirmation together. If you used an in-app purchase, the third party appstore sends the receipt confirmation following your order and Ebook sends you the separate order confirmation shortly after. Afterwards, we send a contract confirmation on permanent data carrier (email), which includes these documents: order, General Terms and Conditions, and order confirmation. This marks the beginning of your subscription. We ensure that all personal data is treated with respect to data protection regulations; for more information refer to our Privacy Statement.
  • 4.5 You can also upgrade to a paid subscription using in-app purchases on either our iOS or Android apps. Select the desired option from the subscription page on the app, and a pop-up will ask you to enter your password for the third party appstore. Upon entry, another window will appear where you must again confirm your purchase before it is activated. You can still back out at this point if needed. Finally, once completed, a receipt confirmation should be sent to you by the third party appstore (not Ebook).
• 5. Phases of trials and testing
  • 5.1 Ebook occasionally offers in particular to new users free Subscription Access for testing purposes for a certain period of time ("Trial"). Ebook determines, at its sole discretion, if you may participate in a Trial. Whenever there is a serious reason for discontinuing or changing a free trial, Ebook may do so at any time without prior notice.
  • 5.2 You can only participate in certain Trials if you enter your payment details when you sign up for the Trial. In such a case, we need your consent at the beginning of the Trial that your free access will be converted into a paid Subscription Access (Section 4) on the day following the end of the Trial. A recurring subscription can be terminated up to one day in advance of the expiration date of the subscription period (Section 8.2).
  • 5.3 The Subscription Access and the charge associated with it must be cancelled by you before the end of the Trial in Section 5.2 if you do not wish to have it. You can do so by visiting your Ebook Account Settings or the respective app store settings, for example.
• 6. Credits and audiobooks
  • 6.1 Purchasing Audiobook Content through the Platform is possible if you register with Ebook. The platform allows you to purchase Audiobook Content on an à la carte basis. Customers who have Subscription Access are not required to purchase Audiobook Content. However, Ebook will often offer more attractive pricing for customers who have Subscription Access.
  • 6.2 If you have Subscription Access, you may purchase credits for use on Audiobook Content. Customers with Subscription Access may also be offered credits as a promotion, reward or incentive. These credits are only redeemable by those with Subscription Access and expire eighteen months from the date they were issued (for example: a credit received August 1, 2020 will expire on January 31, 2022). Ebook applies the oldest credit first at purchase, so that users will always take advantage of credits which are expiring soonest.
  • 6.3 You submit a legally binding offer for the Audiobook Content and/or credit/s that you have selected, if you enter the requested information in the online order form and click on the button "Order with obligation to pay". In doing so, you submit an offer to purchase a contract that is legally binding. You can change and view the data at any time before you submit your order.
  • 6.4 Once Ebook has accepted your purchase by sending a notice of acceptance (order confirmation) via email, the contract is complete. This notice will usually be sent out within a reasonable amount of time, along with a receipt confirmation if you purchased your Audiobook Content and/or credit/s via Ebook’s web-based application. If you conducted an in-app purchase, you'll receive your receipt from the third party appstore and Ebook will follow up with an order confirmation. The text of the contract (consisting of the order, the General Terms and Conditions and the order confirmation) will be sent to you on a permanent data carrier (email).Your personal information is kept confidential according to our Privacy.
